ChexCard(tm) Cardholder Terms & Conditions Disclaimer You must read this! This is a Terms & Conditions for a ChexCard brand MasterCard. It is a Debit MasterCard which allows you to deposit funds into an electronic account associated with this card. This is NOT A CREDIT CARD and has no credit limit. You may make purchases at any merchant accepting MasterCard or cash withdrawals at any ATM machine displaying MasterCard, Pulse. However, you may only make purchases or withdrawals up to the total amount on deposit in your card account. You may deposit cash funds into your card account using the methods described in this form. To qualify for the ChexCard MasterCard you must provide your name and a valid mailing address. We reserve the right to refuse your application for any reason. You must agree to the Terms & Conditions contained herein. Catalog Number: 03263306 Loading Your ChexCard(tm) A. Direct Deposit by Employer or Government If your employer or government agency offers Direct Deposit, you may have your salary or payment deposited directly into your ChexCard(tm) account each pay period. Give your employer or the government, the bank number, ABA 031918569 and your Account Number (your 16-digit card number, also located on the front of your card). They will ask you to sign an authorization, which will allow them to make the direct deposit. It may take a couple of weeks for the bank to initially set-up this direct deposit transaction. Check our website, www.chexcard.com for the status of your account. B. MoneyGram Agents You may load up to $10,000 to your ChexCard(tm) account at any MoneyGram Agent. Tell the agent you wish to make an ExpressPayment transaction to your card, using Receive Code. You will complete MoneyGram's Express Payment form by filling in the 16-digit ChexCard account number and Receive Code number in the designated blanks. Then complete your name and address in the appropriate blanks. Give the agent the completed Express Payment form, the amount to be transferred and pay the MoneyGram fee. This transfer should be credited to your card account within the next business day. You can find the nearest MoneyGram agent by calling 1-800-MoneyGram or on the Internet at www.MoneyGram.com. C. Card-to-Card Transfer You may use the automated telephone system (IVR option found in the "enhanced services" of the customer service 800#) to transfer money from one ChexCard to another ChexCard. Have your ChexCard card account number and passcode and the ChexCard card number of the "transfer to" cardholder ready when you call. You may also make this transfer on our website @ www.chexcard.com ChexCard(tm) Cardholder Terms and Conditions ChexCard(tm) MasterCard(r) is offered under license from MasterCard(r) International, Merchant Bankcard Services Corporation, and Stonebridge Bank and is subject to all the terms and conditions you will receive with your card. Use of your card indicates acceptance on your part of all specified terms and conditions. I. Terms & Conditions for ChexCard(tm) By accepting and using your ChexCard(tm), you agree to be bound by these terms and conditions. In this agreement, "Debit Card" means all cards issued by Stonebridge Bank, which maintains your account. "Debit Card" is a ChexCard(tm) MasterCard(r), which will feature either the ChexCard(tm) logo and/or another authorized sponsor. "You" and "Your" mean the customer and program participant to whom we issue a Debit Card in conjunction with our sponsoring client company. "We", "Us", and "Our" means Merchant Bankcard Services Corporation ("MBSC"), which sponsors the Debit Card or anyone we assign our rights to. II. Definition The ChexCard(tm) MasterCard(r) is a proprietary form of debit card. It does not connect in any way to your or any other checking account. In conjunction with our client company's promotional program and the rules associated therewith, you may qualify to have a card issued and monies funded into the card. III. Using Your ChexCard(tm) A. You may be able to use your ChexCard(tm) to: 1. Pay for purchases at merchants which have agreed to accept the MasterCard(r) ("point-of-sale transactions"). 2. Obtain cash from participating financial institutions (over-the-counter transactions). 3. Withdraw cash at MasterCard(r) automated teller machines (ATM). 4. Access our telephone and Internet banking services. B. You may not transfer the cash balance to another bank or card product except through our telephone banking or Internet services, when available. C. The Debit Card and Personal Identification Number (PIN) are provided for your use and protection, and you will: 1. not disclose the PIN nor record it on the Debit Card or otherwise make it available to anyone else; 2. use the Debit Card, the PIN and any ATM and Debit Terminal as instructed; 3. promptly notify us of any loss or theft of the Debit Card or PIN; and 4. be liable for the Debit Card and the PIN and for their authorized use, as described in the "Loss, Theft or Unauthorized Use" section. D. Your card may not be used for illegal transactions or to buy illegal goods or services. IV. Payment Each time you use your ChexCard(tm), the amount of the transaction will be debited from your account. You are not allowed to exceed your funded balance by any individual or series of purchases. You promise to pay us the charges incurred on this account and agree that we may deduct these charges directly from your account. These charges may be for services that you request that are not included in this disclosure or the schedule of Applicable Fees contained herein. V. Use of Telephone Banking and Internet Banking Services A. You may obtain account balances. B. You may review recent account activity. C. You may transfer available funds to another ChexCard(tm) account. D. You may initiate the transfer of funds from a U.S. bank account to your ChexCard(tm) account. VI. Business Days A. Our business days are Monday through Friday, excluding holidays. B. Hours of operation: 9 a.m. to 5 p.m. Central Standard Time. VII. Service Charges There may be a service charge for certain transactions. A charge will be assessed to you if we issue a new Debit Card number and card when your card is lost or stolen. This charge will be immediately debited to your account. Additional Fees for the use of the card may be charged to you by banks and other processors and debited to your card account. VIII. Verification of Transactions A. You will not receive a printed statement, however you may access each of your transactions through our telephone banking or Internet banking service. B. A printed statement will be furnished upon request for an additional fee, which will be debited immediately to your account. IX. Failure to Complete Transactions A. MBSC accepts no liability to complete funding that has not been supplied by you or your sponsoring company according to the rules of the program. B. Likewise, MBSC accepts no responsibility for funding delays that are the result of late receipt of funding payments by you or your sponsoring company. C. We are not responsible if you do not have enough money in your account to complete a particular transaction. You may or may not, however, split your purchases between the ChexCard(tm) and another credit or debit card or cash. If you are uncertain as to your exact balance, please call Cardholder Services Toll Free number on the back of your card to verify your balance prior to attempting to make a purchase. D. If you authorize a transaction and then fail to make a purchase of that item as planned, the approval will result in a credit hold for that amount of funds for the next 5 days. E. Neither we nor any other bank or business will be liable to you for failure to honor the card. X. Disputes You agree to settle all disputes about purchases you make using the ChexCard(tm) with the merchant who honored the card. XI. Foreign Transactions Foreign currency transactions will be converted to US dollars under the current applicable rules of MasterCard( International. XII. Returns and Refunds If you are entitled to a refund for any reason for goods or services obtained with a Debit Card, you agree to accept credits to your account in place of cash. XIII. Amendment Cancellation A. We may at any time change or repeal these terms and conditions. You will be notified of any amendment via our telephone banking or Internet banking services. B. We may cancel or suspend this agreement at any time. The Debit Card remains property of the bank. We may cancel your right to use the Debit Card at any time. You may cancel this agreement by returning the Debit Card to us. XIV. Other Terms A. Your Debit Card and your obligations under this agreement may not be assigned. We may transfer our rights under this agreement. B. Use of your Debit Card is subject to all applicable rules and customs of any clearinghouse or other association involved in transactions. C. We do not give up our rights by delaying or failing to exercise them at anytime. D. If any term of this agreement is found by a court to be illegal or not enforceable, all other terms will still be in effect. XV. Regulatory Authority Your rights in connection with electronic funds transfers are governed, in part, by the laws applicable to your country of origin, residence or use of this card. XVI. Consumer Liability If you believe your Card has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call Customer Service at the number on the back of your Card, which is accessible 24 hours a day, 7 days a week. If you fail to notify us promptly, you could lose all of the money on your account If your Card has been lost or stolen, we will deactivate it to keep your losses down. In any transaction where a PIN is required, use of your PIN will authorize such transaction and you will be liable for any transaction made with your PIN. You are responsible for all uses of your card including those in which a PIN number or Passcode may not be required. Additionally, you are responsible for all transactions made through the use of your Passcode. XVII. The following Notice Contains Information About Your Right to Dispute Errors. A. In case of errors or questions about your electronic transactions, call the Customer Service Toll Free number on the back of your card or write to Cardholder Services, P.O. Box 846, Salem, OR 97308 as soon as you can if you think your statement or receipt is wrong or if you need more information about a transaction listed on the statement or receipt. Or, use our Internet service at www.chexcard.com. We must hear from you no later than 60 days after the transaction occurred. B. The following information must be contained in that notice: 1. Your name, account number and Social Security Number. 2. Describe the error or the transaction you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information. 3. Tell us the dollar amount of the suspected error. C. If you tell us orally, we require that you send us your complaint or question in writing within 10 business days. D. We will tell you the results of our investigation within 10 business days (20 business days for transactions from an account made within 30 days after the first deposit to the account was made) after we hear from you and correct any error promptly. If we need more time, however, we may take up to 45 days (or 90 days for transactions initiated outside of the United States, if a point of sale transaction was involved, or if the transaction was from an account and the transaction occurred within 30 days after the first deposit to the account was made) to investigate your complaint or question. If we decide to do this, we will re-credit your account within 10 business days (or 20 business days, if applicable) for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. Since we ask you to put your complaint or question in writing, if we do not receive written confirmation of your oral notice within 10 business days, we will not re-credit your account. E. If we decide there was no error, we will send you a written explanation within three (3) business days, after we finish our investigation. XVIII. Applicable Fees: A. Additional fees may be charged by the ATM machine owner/operator, disclosed during your transaction and billed to your account. *** This fee only occurs when using your card outside the U. S. A currency exchange may require additional fees paid to the bank or currency agent. This rate and fee applies to the conversion of currency at an authorized ATM machine that accepts MasterCard(r) cards. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records. * An affiliate is a company we own or control, a company that owns or controls us, or a company that is owned or controlled by the same company that owns or controls us. Ownership does not mean complete ownership, but means owning enough to have control. * A nonaffiliated third party is a company that is not an affiliate of ours including Merchant Bankcard Services Corporation. * Merchant Bankcard Services Corporation is the operator of the ChexCard(tm) MasterCard(r) program sponsored by Stonebridge Bank and under a license granted by MasterCard(r). THE INFORMATION THAT WE COLLECT We collect nonpublic personal information about you from the following sources: * Information we receive from you on applications or other forms * Information about your transactions with us * Information about your transactions with nonaffiliated third parties INFORMATION WE DISCLOSE ABOUT YOU We do NOT disclose any nonpublic personal information about you to anyone, except as permitted by law. THE CONFIDENTIALITY, SECURITY, AND INTEGRITY OF YOUR NONPUBLIC PERSONAL INFORMATION We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information. NONPUBLIC PERSONAL INFORMATION AND FORMER CUSTOMERS If you decide to close your account(s) or become an inactive customer, we will follow the privacy policies and practices as described in this notice.
